Is A Nightclub Responsible For The Criminal Behavior Of Others?

While businesses ordinarily have no duty to protect customers from criminal acts of third parties which occur on its premises, there is a responsibility to take reasonable steps to protect its customers.  If the business knows, or has reason to know that criminal acts against its customers or its premises are reasonably foreseeable, the nightclub has a responsibility to increase security.

If the nightclub knew about past criminal activity by third parties and failed to act responsibly, the business may be responsible to pay damages if a customer is injured by the criminal behavior of a third party.
